QCMD Marketing
1. Scope of Service
Included in Service:
WhatsApp API Connection Capability, Templates Capability Phone Number Connection Capability, SaaS platform access for managing WhatsApp interactions. System is available via the CRM system that is included (limited to conversations & Contacts)*
Explicitly Excluded from Service:
WhatsApp Telephone Number (Client responsibility)System Setup (Client responsibility); Booking SystemAutomated Workflows; WhatsApp Appointment Flows CRM System (WhatsApp API related) Subscription to Unlimited Contacts Unlimited SendsBulk Messaging Marketing System including: Social Planner (SMVM)Email CampaignsSnippetsCountdown TimerTrigger Links Listings (up to 6 business data)Reviews and Reputation Management capabilities Email campaign templates, Snippets templates, Countdown timer, trigger links. Ai employee, All-In-One-Chatbot.
Additional features listed under exclusions can be made available via separate upsell or downsell offers from QCMD Marketing at additional costs.
2. Pricing & Payment Terms
A once-off setup fee of R139 (once-off for CRM system with WhatsApp API ability, is payable upon commencement of service.The service operates on a pay-as-you-go basis, charging per message (WhatsApp, SMS, Email) sent.Clients are required to maintain a positive credit balance in their account, loading credits proactively.Clients must set their own reload threshold and recharge amounts. There are no monthly subscription fees (for the System as purchased) ; however, clients are fully responsible for managing their credit and ensuring availability of sufficient funds to cover message sending.
3. 30-Day Money-Back Guarantee
Eligibility for Refund:
Refund requests must be based on verified technical malfunctions or failures directly attributable to the SaaS platform, occurring within 30 days of initial purchase.
Exclusions from Refund Policy:
Dissatisfaction unrelated to technical malfunction (e.g., user preference, change in business strategy)Issues arising from client misuse or misunderstanding of provided servicesErrors caused by third-party integrations or applicationsComplaints regarding services explicitly listed as excludedInsufficient client balance or failure to maintain required account credit
Refund requests must be submitted in writing via email to QCMD Marketing within the stipulated 30-day period for consideration.
4. Client Obligations
Clients must adhere strictly to the following obligations:
Maintain current and valid payment information for account credit reloads.Comply fully with WhatsApp Business guidelines and applicable terms of use.Operate within all local and international laws and regulations related to messaging, privacy, and electronic communications.Assume responsibility for all content and data transmitted through the SaaS platform, ensuring it meets applicable legal, ethical, and professional standards.
Non-adherence may result in immediate suspension or termination of service.
5. Termination & Cancellation
Clients may cancel the service by providing a written notice at least 30 days in advance.QCMD Marketing reserves the right to immediately suspend or terminate access if the client engages in misuse or breaches these Terms and Conditions, including but not limited to:Spam messaging or unauthorized bulk messagingIllegal activities or use for unlawful purposesHarassment or unethical business practicesNon-compliance with any obligations outlined in these Terms
Suspension or termination under these circumstances may occur without prior notice, and no refund or compensation will be provided for remaining credit balance or setup fees.
6. Technical & Customer Support
Technical support is provided through recorded Loom submissions detailing the issue.Guaranteed response time within 24 hours; however, most queries are resolved typically within 4-5 hours.Clients must provide detailed and accurate descriptions of their issues to facilitate effective and timely solutions.
7. Intellectual Property Rights
All intellectual property rights related to the SaaS platform, including software, templates, and system-generated content, remain exclusively with QCMD Marketing.Clients are granted a limited, non-transferable license to utilize the provided templates and content exclusively within the platform.Clients are strictly prohibited from selling, redistributing, or transferring any content, templates, or intellectual property provided by QCMD Marketing.
8. Liability & Indemnity
QCMD Marketing's liability is strictly limited to direct damages and will not exceed the amount paid by the client for the specific service in dispute.QCMD Marketing will not be liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of revenue, profits, or data.Clients agree to indemnify, defend, and hold harmless QCMD Marketing from any claims, damages, losses, or liabilities arising from misuse, non-compliance, or illegal use of the SaaS platform.
9. Privacy & Data Security
Payments are securely processed by Stripe, a globally recognized third-party payment gateway. QCMD Marketing does not store or have access to clients' banking or credit card information.QCMD Marketing guarantees confidentiality and security of messaging data and databases hosted within the SaaS platform.Clients bear sole responsibility for maintaining the security and legality of their data and the information shared through the platform.
10. Modifications to Terms
QCMD Marketing reserves the right to modify these Terms and Conditions at any time.Modifications will be communicated to clients via email and/or push notifications.A minimum of 30 days’ notice will be provided prior to the implementation of changes, during which clients may review and accept or reject the revised terms.
